Which Miami pre-construction condos allow Airbnb?

By Lory Minici · Berkshire Hathaway HomeServices EWM Realty · Published October 2026

Short answer: In the Miami Apartamento comparison tool, 14 selling or under-construction developments allow short-term rentals (Airbnb) according to the developers, with entry prices from $461K. Another 5 allow only monthly rentals or a capped number per year. The rule only holds if it is in the condo declaration and the city allows it.

What do the city and the state require?

Building approval is not enough. Each city has its own rules: Miami Beach prohibits rentals of less than six months and one day in all single-family homes and in many residential buildings, allowing them only in zones on the official map, with a city Business Tax Receipt and a Resort Tax account. In Florida, a condo unit rented as a whole more than three times a year for periods under 30 days needs a state vacation rental license from the DBPR.

How do you confirm before buying?

The rule that counts is in the condo declaration delivered with the contract; read the leasing section during the 15-day cancellation period. Check zoning with the city as well. Frequently asked questions

Does every new condo in Miami allow Airbnb?

No. In the comparison tool, only 14 of the selling or under-construction developments allow short-term rentals; many luxury buildings and the Coral Gables projects prohibit or limit them.

Do I need a license to rent nightly?

Usually yes: a state vacation rental license (DBPR) when the whole unit is rented more than three times a year for under 30 days, plus city requirements and lodging taxes.

Is a condo-hotel the same thing?

Not exactly. In a condo-hotel, the unit can join a rental program run by the hotel brand, with rules and revenue split set in the contract.
